What does “No Win, No Fee” really mean?

Literally speaking, the term “No Win, No Fee”, means that if you do not win your personal injury claim for compensation, then you do not have to pay your Solicitors fees.

We offer a genuine "No Win No Fee" service, which means that we will pursue your personal injury claim for free. We do not charge you for our work on lost cases and we recover our legal costs from the losing party (or their insurer) when we win the case.

However, unlike Claims Management Companies, we will not deduct any money from your compensation even if we win the case.

How long will my personal injury claim take?

The length of time a claim takes will depend on the particular circumstances of the case. As an example, a relatively minor road traffic accident may well be settled within months, whilst more serious injuries may take longer. We would advise that you speak to the team at Veja & Co Solicitors in order that they can give you more information about your case.

How long do I have to make a personal injury claim following my accident?

Generally you have three years from the date of your injury to make a claim. However, there are exceptions. If the accident involves a minor (somebody who is under 18 years of age), the three year does not start until the minor's 18th birthday. There are other exceptions to this three-year rule, which your solicitor will explain.

How much is my claim worth?

The assessment of general damages for pain and suffering and loss of amenity is based broadly on the assessments of previous similar personal injury accident claims made by trial judges.

The amount of compensation you will receive if the personal injury claim succeeds is made up of two parts.

"General Damages" - this is the term given to the pain and suffering element. The value of General Damages depends on the type of injury you have suffered, how long you were suffering from your injury, and whether your injury is going to have a long term effect on your life. "Special Damages" - this is the term given to your out of pocket expenses incurred as a result of the accident. This may include loss of earnings, care charges, loss of vehicle excess, hire of a replacement car, cost of public transport, prescriptions, etc.

This amount is added to the value of your general damages to make up the overall damages award.

What is CRU repayments?

If you have been receiving money from the State as a result of your absence from work, then at the end of the case some of this will have to be refunded to the Compensation Recovery Unit.

Briefly, the purpose of this is to prevent 'double recovery'. If you have received compensation for your loss of earnings, as well as unemployment benefits, then you would otherwise be compensated twice over in respect of the same losses.

What happens if I decide I don’t wish to pursue the claim once it’s started?

This depends on the stage at which you decide to withdraw. If a member of our team advises you that your claim is not likely to succeed, you may withdraw and pay nothing. If on the other hand you decide not to proceed for reasons personal to you, you may be billed for all charges incurred on your behalf up to that point.

Do I have to meet a member of the admin team in person?

Not unless you want to. It is possible to deal with most claims entirely by telephone, post or e-mail. However, at Veja & Co Solicitors we believe that meeting in person is always beneficial and as a result, do encourage clients to visit us at our offices should they wish.
